PRAYER : Criminal Original petition is filed under Section 482 of Criminal Procedure Code, to direct the respondent to register the petitioner complaint dated 11.01.2022 on the file of the respondent.

ORDER

Mr.A.Gokulakrishnan, learned Additional Public Prosecutor takes notice on behalf of the respondent.

2. This Criminal Original Petition has been seeking to direct the respondent to register the petitioner complaint dated 11.01.2022.

3. It is reported by the learned Additional Public Prosecutor that the petitioner is not co-operating with the investigation and he has also not appeared before the respondent so far.

4. The learned Additional Public Prosecutor for the respondent further submits that the complaint given by the petitioner to the respondent viz., The Commissioner of Police, Office of Commissioner of Police, Avadi has been forwarded to the Inspector of Police, Red Hills Police Station, Chennai in C.No.55/COP-PG/COMP/2022.

5. The learned counsel for the petitioner would submit that the petitioner is ready to appear before the Inspector of Police, Red Hills Police Station, Chennai at any time as directed by this Court.

6. Mr.Vikram Veerasamy, the learned counsel appearing for the proposed accused seeks to implead in this petition. He would submit that the petitioner has been repeatedly giving complaints against the proposed accused and he would further submit that civil litigations are pending between the parties and this Court in Crl.O.P.No.2954 of 2021 dated 17.12.2021 had given a categorical finding that the petitioner has committed fraud on the Court and prays that he may also be permitted to appear for enquiry and produce necessary documents before the Investigating Officer.

7. Despite information given to the petitioner by the Inspector of Police, the petitioner has not appeared for enquiry. The petitioner is directed to appear before the Inspector of Police, Red Hills Police Station, Chennai on 12.02.2022 at 5.00 p.m. and the proposed accused is directed to appear before the aforesaid Investigating Officer at 7.00 p.m.

8. The Inspector of Police, Red Hills Police Station, Chennai shall conduct enquiry and proceed in accordance with law.

9. This Criminal Original Petition stands closed with the above observations and directions.
