Prayer:- Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, calling for the records relating to the order dated 21.09.2004 passed in I.D.No.8 of 1998 on the file of the 2nd respondent and quash the same and consequently direct the 1st respondent to reinstate the petitioner as Clerk cum Checker in the respondent bus services company with all backwages, continuity of service and all service benefits.

O R D E R

This Court passed an order on 08.09.2009 as follows: "It is brought to the attentions of the advocate that the above matter was listed before the Deputy Registrar (A.S.) for default in payment of batta so as to effect service on the respondents.

2. Since the batta has not been paid till today inspite of sufficient opportunity given, the matter is listed today before this Court as a last chance.

3. Advocate is directed to pay batta on or before 01.10.2009 and proof of compliance to be filed immediately. If batta is filed as directed issue notice immediately. Failing payment of batta as directed, the petition shall stand dismissed automatically without reference to the Court."

2. The writ petition is listed today for hearing. On verification, the petitioner is unable to establish that the defects notified by the Registry has been complied with.
