The petitioner seeks for a direction to transfer the investigation in Crime No.245 of 2015 pending on the file of the second respondent to the third respondent with a direction to investigate into the matter and file charge sheet in accordance with law.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. It is represented by the learned Additional Public Prosecutor that the case in Crime No.245 of 2015 was closed as mistake of fact on 26.02.2015. A copy of RCS notice is served to the learned counsel for the petitioner across the bar. https://hcservices.ecourts.gov.in/hcservices/

4. The respondent police is directed to file the closure report before the Judicial Magistrate concerned, after due notice to the defacto complainant and the defacto complainant is entitled to file protest application before appropriate authority .
