Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents herein to furnish the documents relied in AnnexureIII and Annexure-IV of the charge memo issued by the second respondent herein in Memo No.15585/C1/2017 dated 23.11.2017 so as to defend the charges effectively by the petitioner. ORDER

This writ petition has been filed seeking a mandamus directing the respndents to furnish the documents relied upon in the charge memo No.15585/C1/2017 dated 23.11.2017, more specifically the copies of the Annexure-III and Annexure-IV, so as to enable the petitioner to defend the charges effectively.

2. Learned counsel for the petitioner, referring to Annexure-III enclosed with the charge memo, submitted that the report of the Vigilance and Anti Corruption Department dated 'Nil' should also be furnished to the petitioner. He further submitted that a reading of Annexure-IV shows that the respondents are going to rely upon some of the deposition given https://hcservices.ecourts.gov.in/hcservices/

by some witnesses against the petitioner, hence, the same should be furnished to him.

In reply, Mrs.P.Rajalakshmi, learned Additional Government Pleader for the respondents, providing a copy of the letter dated 3.2.2014 and the enquiry report dated Nil.Oct'16, submitted that the copy thereof has already been given to the petitioner and no other document is going to be relied upon. Again referring to Annexure-IV, she submitted that the respondents are going to examine only Mr.P.Sivasankaran, who is working as Assistant Professor (Maths) in Sree R.Govindasamy Government Arts College, Tindivanam and not the deposition given by some other witness.

4. Recording the statement made by the learned Additional Government Pleader for the respondents, this writ petition stands disposed of directing the petitioner to appear before the enquiry officer as and when called upon by issuing notice.
