Today, i.e. 18.11.2024, when the matter is taken up for hearing, the learned counsel for the plaintiff would submit that the plaintiff viz, Dr.V.Sathish died on 14.07.2023. His legal heirs are not willing to contest this case. He has also made an endorsement to that effect.

2. Considering the submission made by the learned counsel for the plaintiff and in view of the endorsement made, this Testamentary Original Suit is dismissed as abated. No costs.
