Originally this petition has been filed as Original Application No.2226 of 2003 before the TamilNadu Administrative Tribunal at Chennai and after abolition of TNAT, petition has been transferred and numbered as W.P.No.13846 of 2006. Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to set aside the order of the Director of Agricultural Marketing, Trichy made in A.P.K218566/91 dated 30.11.1992 and to direct the respondents to promote the applicant as the first person in the seniority list.

The petitioner has filed Application before the Tamilnadu Administrative Tribunal, Chennai in the year 2003 in O.A.No.2226 of 2003. Subsequently, due to abolition of the Administrative Tribunal, the matter has been transferred to this Court and renumbered as W.P.No.13846 of 2006.

2. This Writ Petition has been filed challenging the order passed by the second respondent in A.P.K218566/91 dated 30.11.1992 and to direct the respondents to promote the applicant as the first person in the seniority list.

3. The learned Additional Government Pleader would submit that during the pendency of Writ proceedings, the petitioner got promotion vide proceedings dated 23.04.2004 and subsequently got retired on attaining the age of superannuation on 30.04.2006. Subsequently the petitioner gave a letter to the second respondent/Department dated 29.10.2010 stating that he would withdraw the Writ Petition and not pressing for the relief. He further has filed the copy of the proceedings of the 2nd respondent dated 29.10.2020 in Na.Ka. No.E1/2106/2020, mentioning the subsequent developments and the withdrawal of Writ Petition filed by the petitioner herein. Hence, the learned Additional Government Pleader prayed that this Writ Petition is liable to be dismissed as infructous.

4. Recording the submission of the learned Additional Government Pleader, this Writ Petition is dismissed as infructuous. No costs.
