ORDER
The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 303(2) and 21(1) of BNS, 1/4
in Crime No.3 of 2026, on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that based on the secret information, the respondent police went to the scene of occurrence and found that the petitioner had illegally quarried and transported 3 units of gravel sand from Krishnapuram. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and vehemently opposed to grant anticipatory bail to the petitioner.
5. Considering the nature and gravity of offence, the petitioner had illegally quarried and transported river sand and caused damage to ecology and hence, I am not inclined to grant anticipatory bail to the petitioner. 2/4
6. Accordingly, this Criminal Original Petition stands dismissed. 29.01.2026 Vv To
