For Petitioner : M/S.M.MURUGESAN Advocate For Respondent : MR.S.SANTHOSH, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 417, 465, 468, 34 and 120B of IPC in Crime No.245 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and other accused persons were involved in conducting of fake interviews and recruitment in the name of AICTE (All India Council for Technical Education) and issued fake appointment orders to 18 people. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. Mr.S.Santhosh, learned Government Advocate (crl.side) appearing for the respondent police raised objection stating that investigation is pending. Hence, he opposed for grant of anticipatory bail to the petitioner.

The averments found in the First Information Report and the submissions made by the learned Government Advocate (crl.side) disclosed the fact that during the relevant point of time the petitioner and others joined together and after publishing the advertisement for calling for application to the post in Indian Government, they looted a money to the tune of nearly Rs.1.5 crores and as of now, the prime accused is not arrested. Apart from that, in many incidents the petitioner and others conducted bogus interview and exploited in many districts. Hence, considering the gravity of offence, this court is not inclined to grant anticipatory bail to the petitioner.
