The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 126(2), 296(b), 309(4), 311 and 351(3) of BNS in Crime No.11 of 2026, on the file of the respondent Police, seek anticipatory bail.
2. The allegation against the petitioner is that the petitioner along with other accused waylaid the defacto complainant and snatched a sum of Rs.1,250/- from the defacto complainant. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and for statistical purpose, false case has been foisted by the respondent police since he has some previous cases. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that, apart from this case, petitioner has three previous cases, out of which, two cases are under 302 of IPC. He further submitted that, A1 in this case has arrested and still in custody. Hence, he opposed for grant of anticipatory bail to the petitioner.
5. Considering the nature of allegations and the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 27.01.2026 sma
