O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 191(3), 126(2), 296(b), 109, 125, 351(3) r/w 3(5) of BNS, in Crime No.735 of 2025 on the file of the respondent Police, seeks anticipatory bail. 1/4

The earlier criminal original petition in Crl.O.P.No.34682 of 2025 seeking anticipatory bail has been disposed of by this Court by an order dated 18.12.2025 on the following reasons: "5.Considering the nature of allegations and the fact that though injured is alleged to have discharged from the hospital and considering the bad antecedents, I am not inclined to grant anticipatory bail to the petitioners"

The learned counsel appearing for the petitioner submitted that only on the confession of the co-accused, the petitioner was ranked as accused in this case and hence, seeks anticipatory bail. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that still the case is under investigation and the petitioner is having seven previous cases. 4.

Heard the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence and antecedents of petitioner, the fact that there is no change in the circumstances, this Court is not inclined to revisit the earlier order. 2/4
