Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondents not to proceed further based upon the Inspection Report Ref.No.CHN/RO/COMP/TN/48704/EO/Div22/Inspn/2014 dated 31.12.2014 till such time the pronouncement of the judgment by the Division Bench of this Court in W.A.Nos.982, 985, 1026, 1343 and 1344 of 2011 and W.P.No.24519 of 2014 and the Civil Appeals Nos.3965, 3966 of 2013 by the Hon'ble Supreme Court/High Court on the issue. O R D E R
The relief sought for in the present writ petition is to direct the respondents not to proceed further based upon the Inspection Report Ref.No.CHN/RO/COMP/TN/48704/EO/Div22/Inspn/2014 dated 31.12.2014 till such time the pronouncement https://hcservices.ecourts.gov.in/hcservices/
of the judgment by the Division Bench of this Court in W.A.Nos.982, 985, 1026, 1343 and 1344 of 2011 and W.P.No.24519 of 2014 and the Civil Appeals Nos.3965, 3966 of 2013 by the Hon'ble Supreme Court/High Court on the issue.
2. The Hon'ble Supreme Court of India decided the issues in relation to the allowances to be calculated. Thus, the learned counsel for the writ petitioner made a submission that they have to work in respect of calculations liability, if any, and initiate all further actions with reference to the inspection report dated 31.12.2014.
3. In view of the submission, the writ petitioner is permitted to withdraw the writ petition. However, the writ petitioner is at liberty to challenge the inspection report dated 31.12.2014, if they have chosen to do so.
4. Accordingly, the writ petition stands disposed of as withdrawn. No costs. Consequently, connected miscellaneous petition is closed.
