ORDER

The petitioner, who apprehend arrest for the alleged offence under Sections 4(1)(c)of TNP Act (Tansport) in Cr.No.9 of 2026, on the file of the respondent police seeks anticipatory bail.

The allegation against the petitioner is that the petitioner herein is arrayed as A4 and that when the respondent police intercepted and recovered 180 liquor bottles from A2 and A3, it was revealed that this petitioner, being a salesman in a liquor vending shop, had supplied the same for the purpose of transporting them into Tamil Nadu and selling them at a higher price. Hence, the case has been registered against the petitioner.

The learned counsel appearing for the petitioner submitted that the petitioner is only a salesman in the liquor vending shop and that he has been falsely implicated in this case based solely on the confession statements of the other accused. He further submitted that the petitioner is ready to cooperate with the investigation. Therefore, he prayed for grant of anticipatory bail to the petitioner.

Per contra, the learned Government Advocate (Criminal Side), appearing for the respondent police, reiterated the prosecution case and, on instructions, submitted that the petitioner has two previous cases, out of which one is of a similar nature and the other is an NDPS Act case, and hence opposed the grant of anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record. 2/4

6. Considering the nature of the allegations, the fact that a huge quantity of liquor bottles was recovered, and the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
