The learned Counsel for the Petitioners submits that the petition has been filed to condone the delay of 760 days in filing the Appeal in C.M.A.S.R.No.9122 of 2025.
2. Learned Counsel for the 1st Respondent present in Court and Notice to the 2nd Respondent was dispensed with.
3. Learned Counsel for the 1st Respondent has no objection provided that the interest for the period of delay of 760 days is waived.
4. Accordingly, this Petition is allowed on condition that the Petitioner is not entitled to claim interest for the period of delay of 760 days and the delay of 760 days is condoned.
5. Registry is directed to number the Appeal if it is otherwise in order.
6. Mr.A.Pradeep, learned Counsel undertakes to file Vakalat for Respondent-1.
