This Criminal Original Petition has been filed to direct the respondent to register a case on the complaint of the petitioners' dated 01.05.2016, to investigate and to file a final report.
2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the respondent.
3. The learned Additional Public Prosecutor submitted that based on the complaint lodged by the petitioners, petition enquiry is pending in CSR.No.121 of 2016 before the respondentPolice.
4. Recording the submission of the learned Additional Public Prosecutor, the respondent police is directed to conduct enquiry expeditiously and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble https://hcservices.ecourts.gov.in/hcservices/
Supreme Court in Lalita Kumari v. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner.
With the above direction, this Criminal Original Petition is clsosed.
