Decree : This Second Appeal is coming on for hearing on this day and upon perusing the grounds of Appeal, the judgment and decrees of the Lower Appellate Court and the Court of first instance and the material papers in the suit and upon hearing the arguments of Mr.R.Kannan, Advocate for the Appellant and of Mr.N.Manokaran, Advocate for the Respondent this doth order and decree as follows:

i) that the judgment and decree of the I Additional District Court, Coimbatore made in A.S. No.12 of 2009 dated 09.09.2009 be and hereby is cofirmed and the judgement and decree of the Sub Court, Pollachi made in O.S. No.108 of 2006 dated 30.10.2008 be and hereby is set aside and this Second Appeal do stand dismissed;
