This Criminal Miscellaneous Petition has been filed to modify the condition imposed in Crl.O.P.No.27360 of 2023 by an order dated 04.01.2024.

2. By the said order, the Petitioner/A2 in Crime No.848 of 2023 registered by the respondent police for the offences under Sections 147, 447, 294(b), 323 and 506(ii) IPC read with Section 3 of TN Public Property (Prevention of Damage and Loss) Act, had been granted anticipatory bail.

3. In the said order, one of the conditions was that, the petitioner should deposit a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) as non-refundable deposit to the credit of Crime No.848 of 2023 before the Judicial Magistrate No.I, Perambalur and on such deposit, the Judicial Magistrate No.I, Perambalur must hand it over to the defacto

complainant.

4. In the application filed seeking modification, it has been stated that the petitioner is helping his father in biriyani shop at village and so, it is not possible for him to comply with the said condition.

5. Taking all the factors into consideration, I am inclined to modify the condition imposed on the petitioner. However, the said condition is modified to the effect that the petitioner shall deposit a sum of Rs.10,000/- (Rupees Ten Thousand only) as non-refundable deposit to the credit of Crime No.848 of 2023 on or before 19.03.2024 before the Judicial Magistrate No.I, Perambalur and on such deposit, the Judicial Magistrate No.I, Perambalur must hand it over to the defacto complainant.
