The present Arbitration Application has been filed to grant an ad interim injunction restraining the respondent from disposing or selling the goods received by the respondent under invoices dated 06.01.2023 and 10.01.2023 to any third party.
2. Today when the matter is taken up for hearing, the learned counsel appearing for the applicant submits that the parties have settled their disputes and the respondent has paid a sum of Rs.28,00,000/- to the applicant as part payment and also returned the goods. He further submits that a sum of Rs.5,00,000/- is still pending, which is to be paid by the respondent. In these circumstances, the learned counsel for the applicant seeks permission of this Court to withdraw the present Application with liberty to approach this Court if the amount is not paid by the respondent as agreed. He has also made an endorsement to that effect in the bundle.
3. Recording the submissions made by the learned counsel appearing for the applicant, this Arbitration Application is dismissed as withdrawn with liberty to the applicant to approach this Court, if the respondent is not paid the balance amount to the applicant, as agreed. There shall be no order as to costs.
