ORDER

This petition is filed seeking to issue appropriate directions, directing the second respondent to produce the caught hold alleged vehicle PY 02 J 8877 by issue of police notice No. 22615, dated 07.02.2017 before the Hon'ble Judicial Magistrate No.II, Karaikal.

2. It is submitted that the petitioner's vehicle, which was seized by the respondent police, has been handed over to the Motor Vehicle Inspector, Karaikal, Puducherry.

3. Today when the matter was called the learned Additional Public Prosecutor appearing for the respondent police submitted that since they have already handed over the vehicle to the Motor Vehicle Inspector, the petitioner may be permitted to approach the concerned Motor Vehicle Inspector seeking return of the vehicle and that they have no objection for return of the vehicle.

4. The learned counsel appearing for the petitioner has also submitted that they are ready and willing to pay necessary

charges and execute such affidavits/documents undertaking to produce the vehicle as and when required for the purpose of investigation.

5. Recording the submission made by the learned Additional Public Prosecutor, the petitioner is granted liberty to approach the Motor Vehicle Inspector, Karikal, Puducherry seeking return of the vehicle bearing Reg. No.PY 02 J 8877 by issue of police notice No. 22615, dated 07.02.2017. On receipt of such request seeking return of vehicle, the Motor vehicle Inspector, Karaikal, Puducherry shall forthwith return the same on such condition as he may deem fit and necessary. Such an exercise shall be completed within 2 days from the date of receipt of the request from the petitioner.
