ORDER

[Order of the Court was made by S.S.SUNDAR, J.,] (1) The above writ petition is filed challenging the order of the Tamil Nadu Administrative Tribunal dated 13.11.2002 made in OA.No.7593/1993 by which the punishment imposed on the 1st respondent herein is set aside.

(2) The Tribunal also directed the petitioners herein to reinstate the 1st respondent immediately without further loss of time and held that the 1st respondent is entitled to full wages from the date of filing of the Original Application before the Tribunal. (3) Though the Tribunal allowed the Original Application filed by the

1st respondent herein as early as on 13.11.2002, the writ petition was filed by the petitioners only in the year 2007, after a long delay. This Court also noticed that the notice sent to the 1st respondent through Court was returned with an endorsement indicating that the 1st respondent is no more. (4) Though this Court earlier adjourned the matter for taking steps to implead the legal heirs of the deceased/1st respondent and to amend the cause title, it is seen that no steps have been taken by the petitioners/Government till date.

(5) Today also, there is no representation on behalf of the petitioners. (6) Hence, this Court is left with no other option except to dismiss the writ petition for non-prosecution.

(7) Accordingly, the writ petition stands dismissed for non prosecution. No costs. Consequently, connected miscellaneous petition is closed.
