This petition has been filed to condone the delay of 291 days in filing the CMA.

2. Mrs.R.Sreevidhya, learned counsel takes notice for the second respondent.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay is condoned and accordingly, the petition is ordered.

4. Registry is directed to number the appeal and post the matter in the usual course. Registry is further directed to print the name of the counsel for the second respondent in the cause list.

5. The appellant is not entitled to get interest for the default period.
