[RESPONDENTS] PRAYER : Petition filed Under Article 226 of the Constitution of India praying to issue Writ of Certiorarified Mandamus, to call for the records of the proceedings of the 2nd respondent dated 28.4.2003, in respect of E.B.Connection No.149-01-550 for Flat No.2C, Uma Complex, Kellys, Chennai 600 010 and to quash the same and further forbear the respondents from initiating any action for recovering the penal charges and compounding fees of Rs.46,074/- from the petitioner on the basis of the proceedings of the 2nd respondent dated 28.4.2003 in E.B.Connection No.149-01-550, without providing an opportunity to the petitioner.

When the Writ Petition was listed for hearing on 22.09.2010, there was no representation on behalf of the petitioner and hence, the Writ Petition was directed to be posted under the caption 'for dismissal'. Today, when the writ petition is listed for hearing, there is no representation on behalf of the petitioner. Further, it is submitted by the learned counsel for the respondent Board that the cheque given by the petitioner had also been returned for insufficiency of funds. 2.In the light of the fact that there is no appearance on behalf of the petitioner, it is evident that the petitioner is not willing to get along with the matter and therefore, the Writ Petition is dismissed for non prosecution. No costs.
