PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Certiorarified Mandamus, calling for the records relating to the impugned Award of the Second Respondent in ID No.40/1999 dated 20.06.2002 and quash the same and direct the First Respondent to reinstate the workman Mr.Kandavel in service with all attendant benefits. O R D E R

Challenging the non-employment of one of the members of the petitioner's Union namely, Kandavel, the present writ petition has been filed, challenging the Award dated 20.06.2002 made in I.D.No.40 of 1999.

2. The non-employment of the said workman was in the year 1996 and the I.D came to be dismissed on 20.06.2002. After all these years, when the writ petition came to be listed before this court for final disposal on 19.03.2019 and 09.04.2019, the petitioner herein had sought time for getting instructions.

3. Today, when the matter was called, the learned counsel for the petitioner submitted that they have already sent a registered letter to the concerned workman as well as the petitioner and that he still awaits instructions from them.

4. In my view, sufficient opportunities have been given to the petitioner herein and after so many years, it would not be appropriate to keep the writ petition pending any further. Hence, the writ petition stands dismissed. However, if the concerned workman or the petitioner is still aggrieved and intends to get along with the case, it is open to them to file a review against the orders of this Court, within a period of 30 days from today. No costs.
