Criminal Original petition filed under Section 482 of Code of Criminal Procedure, to direct the trial Magistrate i.e., Additional Mahila Court at Magisterial Level, Egmore, Chennai to dispose of the Crl.M.P.No.3699 of 2018 filed in D.V.C.No.423 of 2017 pending on his file.

ORDER

This petition has been filed to direct the learned Additional Mahila Court at Magisterial level, Egmore, Chennai to dispose of the petition in Crl.M.P.No.3699 of 2018 in D.V.C.No.423 of 2017 at early.

2. The learned counsel for the petitioner has submitted that the petitioner herein has filed an application under section 12 of the Domestic Violence Act, seeking certain reliefs against the respondents herein and based on the same, a case was taken on file in D.V.C.No.3 of 2015 on the file of the Additional Mahila Court at Magisterial Level, Egmore, Chennai. He further submitted that the petitioner has filed Crl.M.P.No.3699 of 2018 under section 91 Crpc to direct the Income Tax Officer to produce the Assessment Order of the respondent herein, from the year 2008 to till date. He further submitted that though the said petition was filed on 01.09.2018, the learned trial court Magistrate after hearing both sides, posted the matter for orders and thereafter he reopened the 1/2 https://hcservices.ecourts.gov.in/hcservices/

matter suo motto and posted the matter under the caption "for clarification'' and he adjourned the matter regularly under the caption "for clarification" and therefore, he requests to direct the concerned Magistrate to dispose of the said petition at early.

3. Admittedly the petition in Crl.M.P.No.3699 of 2018 is pending from 01.09.2018. Hence, the learned Additional Mahila Court at Magisterial Level at Egmore, Chennai is directed to dispose of the Crl.M.P.No.3699 of 2018 within two weeks from the date of receipt of copy of this order.

4. With the abovesaid directions, this Criminal Original Petition is disposed of.
