This Criminal Miscellaneous Petition has been filed seeking to modify the condition 8(b) imposed by this Court upon the petitioner in Crl.O.P.No.24465 of 2024 dated 06.11.2024.

2. It is seen that this Court, while ordering the petition in Crl.O.P.No.24465 of 2024 on 06.11.2024 has directed the petitioner to deposit the original title deeds of the alleged property to the credit of Crime No.9 of 2024 and shall also file an Affidavit of Undertaking that the petitioner would not encumber the property or convey the same to anyone. Pursuant to the order, the petitioner had complied with the condition, however, now the present petition has been filed seeking to modify the said condition. https://www.mhc.tn.gov.in/judis 1/2

Learned Government Advocate (Criminal Side) appearing for the respondent police submits that the investigation in this case is still pending and therefore, if the petitioner is permitted to take back the document, it will cause serious prejudice to the course of the investigation. Hence, he opposed for modifying the condition.

4. Having heard both sides and perused the materials available on record and taking note of the fact that the investigation in this case is still pending, this Court is not inclined to modify the condition imposed in Crl.O.P.No.24465 of 2024 dated 06.11.2024.

5. Accordingly, the Criminal Miscellaneous Petition stands dismissed for the present.
