For Petitioner :
Mr.S.Mohan
O R D E R
This Writ Petition has been filed challenging the order dated 30.09.2021 passed in C.P.No.125 of 2018 by the Labour Court, Kancheepuram.
2. The learned counsel appearing for the petitioner submits that admittedly, the Industrial Dispute raised by the respondents/workmen in I.D.No.11 of 2010 was allowed in favour of them. Aggrieved by the same,
the petitioner Management filed W.P.No.1013 of 2014 before this Court and it is pending. In the meanwhile, the respondents/workmen have filed a claim petition in C.P.No.125 of 2018 before the Labour Court, Kancheepuram, based on the award passed in I.D.No.11 of 2010 by the Labour Court, Chennai, and it was allowed vide impugned order dated 30.09.2021. Challenging the same, this Writ Petition has been filed.
3. Heard the learned counsel appearing for the petitioner. Since no adverse order is going to be passed against the respondents, notice to the respondents is dispensed with.
4. It appears that the respondents/workmen filed I.D.No.11 of 2010 before the Labour Court, Chennai against the petitioner Management challenging the lockout and reduction of 50% wages and to increase the wages and it was allowed in favour of the respondents/workmen vide award dated 03.10.2013. Aggrieved by the same, the petitioner Management filed W.P.No.1013 of 2015 before this Court and it was dismissed for non-
prosecution on 03.03.2015. Since the petitioner Management has not complied with the award passed by the Labour Court in I.D.No.11 of 2010, the respondents/workmen filed C.P.No.125 of 2018 before the Labour Court, Kancheepuram, based on the said award and it was allowed directing the petitioner Management to pay a sum of Rs.36,05,39,448/- as claimed by the respondents/workmen in the petition, to the respondents/workmen with 9% interest per annum from the date of filing the claim petition till the date of deposit. This Court does not find any error in the impugned order dated 30.09.2021 passed by the Labour Court, Kancheepuram in C.P.No.125 of 2018.
5. Accordingly, this Writ Petition is dismissed. There shall be no order as to costs. Connected miscellaneous petitions are closed. 04.02.2025 NCC: Yes / No Index : Yes / No Speaking Order : Yes / No ssb
