O R D E R
This petition has been filed seeking to transfer the investigation in FIR No.244 of 2018 on the file of the respondent to the District Crime Branch at Vellore or any other competent investigation agency.
2. On the complaint lodged by the petitioner, the respondent police have registered a case in Cr.No.244 of 2018 on 23.07.2018 for the offences under Sections 147, 149, 120-B, 384, 357, 447, 427, 423, 424, 380, 465, 467, 468, 471 and 506(ii) IPC, for transferring which, this petition has been filed by the de facto complainant.
3. Today, Mr.S.Mohan, Sub Inspector of Police, SIPCOT Police Station is present.
4. It is the case of the petitioner/de facto complainant that the properties in question worth Rs.3 crores were hypothecated to Punjab National Bank and the accused had trespassed into the premises of the de facto complainant and had taken away the properties after illegally detaining him for about three days.
5. In the opinion of this Court, the SIPCOT Police Station, which is essentially a law and order Police Station, may not be https://hcservices.ecourts.gov.in/hcservices/
well equipped to deal with a case of this nature. Hence, this Court directs the transfer of investigation in Cr.No.244 of 2018 to the District Crime Branch, Vellore. The Inspector of Police, SIPCOT Police Station is directed to obtain necessary orders from the Superintendent of Police, Vellore and handover the case diary in Cr.No.244 of 2018 to the District Crime Branch, Vellore, within two weeks from the date of receipt of a copy of this order.
With the above direction this petition is ordered accordingly.
