Appeal against the judgment and decree dated 22.12.2008 made in M.C.O.P.No.497 of 2006 on the file of Motor Accident Claims Tribunal, Additional Sub-Court, Tiruvannamalai. DECREE:- This Appeal coming on for hearing on this day, upon perusing the petition of Appeal, the Order of the Lower Court and the material papers in this case, and upon hearing the arguments of Mr.E.Rajadurai, for Mr.N.Vijayaraghavan, Advocate for the Appellant and of Mr.T.Arulraj, Advocate for the First Respondent, this Court doth order and decree as follows:- 1.

That the Judgment and Decree dated 22.12.2008 made in M.C.O.P.No.497 of 2006 passed by the Motor Accident Claims Tribunal, Additional Sub Court, Tiruvannamalai, along with interest and costs be and hereby is confirmed and this Civil Miscellaneous Appeal is dismissed;

2.

That the Appellant/Insurance Company be and hereby is directed to deposit the entire amount awarded by the Tribunal along with interest and costs, less the amount already deposited, if any, within a period of six weeks from the date of receipt of a copy of this Judgment;

3.

That on such deposit being made, the 1st Respondent be https://hcservices.ecourts.gov.in/hcservices/

and hereby is permitted to withdraw the amount awarded by the Tribunal, along with interest and costs less the amount if any, already, withdrawn;

4.

That there be no costs in this Civil Miscellaneous Appeal.
