The present Second Appeal is filed to set aside the Judgment and Decree of the First Appellate Court dated 13.11.2009 in A.S.No.4 of 2008 and thereby confirming the Judgment and Decree of the trial court in O.S.No.768 of 2005 dated 14.08.2007.
2. The learned counsel for the appellant seeks permission of this Court to withdraw the present Second Appeal and has also made an following endorsement:- "As the subject matter of Second Appeal is settled between the parties, the appellant may be permitted to withdraw the Second Appeal."
