Petition filed under Article 226 of the Constitution of India for issuing a writ of mandamus to direct the respondents 2 & 3 to forthwith issue necessary patta in favour of the petitioner for the lands in grama natham site, belonging to the petitioner and admeasuring 9,525 sq.ft. comprised in Old S.No.136, New S.No.9 (Part) in Koyambedu Village, Chennai after classifying the same as "private Manai" as per G.O.Ms.No.1971 Revenue dated 14.10.1988.

ORDER

Ms.S.Rekha, learned counsel appearing for the petitioner seeks the permission of this Court to withdraw the Writ Petition with liberty to file a Writ Petition based on the judgment to be delivered in the Civil Suit in C.S.No.564 of 2010 pending on the file of this Court.

2.Recording the submission made by the learned counsel for the petitioner, the Writ Petition is dismissed as withdrawn. It is open to the petitioner to file a fresh Writ Petition based on the judgment to be delivered in the Civil Suit in C.S.No.564 of 2010. No costs. Consequently, the connected miscellaneous petition is closed.
