The present application had been taken out seeking for direction to direct the respondent to pay the debt due amount of Rs.8,02,293.17/- towards the entire setlement along with subsequent interest at 18% p.a. and also to direct the respondent/ debtor to return the assets as per clause 17 of the Lease Agreement.

2. Pursuant to the said application, notice was ordered to be served on the respondent. Inspite of service, he had neither chosen to appear in person nor through any counsel. The cause list also shows the name of the respondent, and when the same was called, he had failed to appear before this Court. It is also to be noted that the evidence has also been recorded in the case. Since he had remained ex-parte, he had also not cross-examined.

3. Considering the averments made in the Report filed in support of this Application and also taking note of the document that had been marked, the present Application is ordered as prayed for. There shall be a direction to the respondent to deposit a sum of Rs.8,02,293.17/- and also handover the assests in the scheduled mentioned properties within a period of eight (8) weeks from the date of receipt of a copy of this order. However, there shall be no order as to costs.
