Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, calling for the records pertaining to the order passed by the Deputy Inspector General of Prisons cum The Superintendent (incharge), Central Prisons, Coimbatore, the 4th respondent herein vide his proceedings No.15200/Po.1/06 dated 2.04.2008 and quash the same as illegal, arbitrary, unreasonable being violative of rules and principles of nature justice and thereby direct the 4th respondent herein to confirm the scale of pay fixed by the Superintendent, Central Prison, Coimbatore vide his order dated 31.01.2006.

O R D E R

This writ petition has been filed against the order passed by the Deputy Inspector General of Prisons cum The Superintendent (incharge), Central Prisons, Coimbatore, the 4th respondent herein vide his proceedings No.15200/Po.1/06 dated 2.04.2008 ordering recovery of excess amount paid to the petitioner with reference to the original fixation of pay.

2. When the matter is taken up for hearing, the learned counsel appearing for the petitioner produced copy of the letter bearing Ref.No.6699/G1/2019 dated 11.06.2019 addressed by the 4th respondent herein to the Government Pleader Office, High Court, Chennai stating that the recovery order was cancelled and the amount recovered from the petitioner has been given credit to the account of the petitioner and nothing survives in the writ petition.

3. Recording the submission made by the learned counsel for the petitioner, this writ petition is dismissed as infructuous. No costs. Consequently connected Miscellaneous Petitions are closed.
