Petition praying that in the circumstances stated therein the High Court will be pleased to pass an order to modify the order passed in Crl.OP.No.22964/2021 dated 17.12.2021 in respect of condition imposed in the petitioner is directed to deposit a sum of Rs.10,000/- (Rupees Ten Thousand Only ) to the credit of the vallalar Sathyagnana Sabai, Vadalur within a period of two weeks from the dated of receipt of a copy of this order and shall produce the said receipt before the Court below and pass such further or other orders. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S. S.C.VISHWANTH, Advocate for the petitioner and of MR.A.GOKULAKRISHNAN, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- This Court by its order dated 17.12.2021 in Crl.O.P.NO.22964 of 2021 granted anticipatory bail to the petitioner on the ground the petitioner, on his own volition was ready to deposit a sum of Rs.10,000/- to the credit of the Vallalar Sathyagnana Sabai, Vadalur as imposed by this Court.
2. This petition has been filed by the petitioner to modify the aforesaid condition as imposed by this Court in Crl.O.P.No.22964 of 2021 dated 17.12.2021.
3. The learned counsel for the petitioner submits that the case of the prosecution is that the petitioner had planted a GANJA Plant in his home. He further submit that the petitioner brother who had
been arrayed as A2 is the main accused and the petitioner is falsely implicated and hence he seeks for modification of deposit of Rs.10,000/- as ordered by this Court and hence, seeks for modification of the condition.
4. Taking into consideration the facts and circumstances of the case, though the petitioner on his own volition came forward to pay the said amount, as he is poor coolie, in the interest of justice, an amount of Rs.10,000/- as found in the para 6(a) respectively shall stands withdrawn.
5. Except the said modification all other conditions imposed in the Crl.O.P.No.22964 of 2021 dated 17.12.2021 shall stands as it is.
6. Accordingly, this petition is modified. All other conditions remain unaltered.
