DECREE:- This second Appeal coming on for hearing on Tuesday, the first day of February Two thousand and Twenty two upon perusing the Grounds of Appeal, the Judgment and Decrees of the Lower Appellate Court and the Court of First instance and the material papers in the suit and upon hearing the arguments of Mr.D.Shivakumaran, Advocate for the Appellants and of Mr.C.Jagadish, Advocate for the Respondent and having stood over for Consideration till this day, this Court doth order and decree as follows;

1. That the Judgment and Decree of the Court of the Subordinate Judge, Namakkal dated 30.09.2009 made in A.S.No.10 of 2006 reversing the judgment and decree of the Court of the Additional District Munsif, Namakkal dated 28.10.2005 made in O.S.No.464 of 2002, be and here by is confirmed and this Second Appeal is dismissed; and
