PRAYER:

Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondent i) to fix basic pension of the retirees of the period from 1.7.1996 to 31.3.1998 by adding 13% D.A. in their revised pension as on 1.1.1996 to enable them to get the benefit of 40% increase in full ii) to modify the G.O.Ms.No.174 Finance (Pension) dated 21.04.1998 suitably to bring the pensioners who have retired between 01.01.1996 and 31.03.1998 on par with those who have retired after 31.03.1998 and pay arrears of commutation of pension, DCRG, encashment of leave on private affairs, full pension qualification for 30 years of services and family pension as per rules.

iii) and in view of the issuance of G.O.Ms.579 Fin (P) Dept dated 15.09.2006 to further direct the respondent to bring pension of retirees of 01.07.1996 to 31.03.1998 period on par with those who retired on or before 31.05.1988 by suo-motu adding at least 30% of the revised pension together with other suitably revised terminal benefits.

Today when this matter is taken up for hearing, the learned Special Government Pleader would submit that subsequently Government Order has been issued by granting the aforesaid benefits to the petitioner and therefore nothing survives for adjudication in this Writ Petition.

2. In view of the same, this Writ Petition is dismissed as infructuous. No costs. Consequently, connected Miscellaneous Petition is closed.
