Comp.Appln.No.158 of 2018 in C.P.No.255 of 2014 Comp.Appln.No.158 of 2018 in C.P.No.255 of 2014 KRISHNAN RAMASAMY, J., Today, when the matter is taken up for hearing, the learned counsel for the Respondent submitted that National Company Law Tribunal (NCLT), New Delhi has passed a winding up order on 09.08.2019 and appointed a Resolution Professional to wind up the Company and therefore if there is any claim, it is for the learned Official Liquidator to file a Claim Statement before the Resolution Professional appointed by the NCLT, New Delhi.
2. In view of the aforesaid position, learned Official Liquidator seeks permission of this Court to withdraw this Application, with liberty to file Claim Petition before the NCLT, New Delhi. She has also made the following endorsement:
"Company undergoing CIRP before NCLT, New Delhi. OL may be allowed to withdraw this claim with direction to submit claim before NCLT with liberty to approach this Hon'ble Court, if deemed necessary."

3. Recording the submission as well as the endorsement made by the learned Official Liquidator, this Company Application is dismissed as withdrawn. However, the Official Liquidator shall file the claim statement, before the Resolution Professional appointed by the NCLT, New Delhi, within a period of four weeks from the date of receipt of a copy of this order.
