ORDER

This Criminal Original Petition has been filed seeking to direct the Judicial Magistrate Court, Rasipuram, Namakkal District to number the petitioner's petition dated 10.01.2022, seeking for return of property and dispose the same within the stipulated time.

2. It is seen that the petitioner's vehicle TATA BOLT XE bearing Registration No.TN-20-CM-3101 has been seized by the respondent in connection with the Crime No.10 of 2022 registered for the offence under Section 147, 294(b), 323 & 506 (ii)IPC. It is the case of the petitioner that the petition seeking for return of property before the Judicial Magistrate Court, Rasipuram. Whereas, the Judicial Magistrate by an order dated 10.01.2022, stating that with regard to the order passed by the Hon'ble High Court, Madras in ROC.23991-A/2020/C3 dated 02.01.2022, appearance of the parties are not allowed, and that it is difficult to get the property from the Respondent Police, had returned the petition.

3. Since, the ROC.23991-A/2020/C3 dated 02.01.2022 has been modified now, the petitioner is directed to represent the application and on such representation, the learned Judicial Magistrate shall number the petition and pass orders in accordance with law.
