Respondent PRAYER : Criminal Revision has been filed under sections 397 read with 401 of Criminal Procedure Code to set aside the Judgment passed in Crl.A.No.2 of 2018 dated 05.09.2018 on the file of the III Additional District and Sessions Court at Kallakurichi in confirming the order of conviction dated 29.12.2017 passed in C.C.No.163 of 2016 on the file of the Fast Track Magistrate at Kallakurichi and sentencing the petitioner to undergo one year simple imprisonment under Section 138 of the Negotiable Instruments Act, 1882 and to pay fine/compensation of Rs.6,00,000/- under Section 357 of the Criminal Procedure Code, 1973.

ORDER

A Joint Memo of Compromise was filed by both the parties. The learned counsels and the parties are present through video conferencing. The parties have confirmed that the matter has been settled out of Court and the terms, which have been subscribed in the Joint Memo of Compromise, is true to their knowledge. In view of the same, the respondent has stated that he does not want to pursue the criminal proceedings against the petitioner.
