Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the first respondent to rectify the mistake in the Allotment Order issued in G.O..(2D) No.121, Housing and Urban Development [Housing 4(2)] Department, dated 21.06.2005 and issue revised order allotting to the petitioner HIG-182, Phase-7, Hosur Housing Unit.

O R D E R

This writ petition was filed for the issue of a writ of mandamus, directing the respondents to rectify the mistake in the Allotment Order and to allot HIG-182, in favour of the petitioner.

2.Heard Mr.P.Rajendran, learned counsel for the petitioner, Mr.T.K.Saravanan, learned Government Advocate for R1, Mr.D.Veerasekaran, learned counsel for R2, R3 and Mr.M.Selvam, learned counsel for R4.

3.It is brought to the notice of this Court by the learned Standing Counsel appearing on behalf of the Housing Board that there is a subsequent development, whereby the petitioner has agreed to pay the amount fixed by the Housing Board, and on such payment, the Housing Board has also agreed to allot HIG-182 in favour of the petitioner. The letter of the Executive Engineer/Executive Officer dated 9.12.2021 was also produced before this Court to substantiate the said submission. 4.In view of the above, this writ petition is disposed of with a direction to the petitioner to pay the amount that has been fixed by the Housing Board and on such payment, the Housing Board shall allot HIG-182 in favour of the petitioner. 5.This writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
