This petition has been filed against the docket order of the Court below wherein the petition filed for discharge was returned on the ground that charges have already been framed by the Court on 11.09.2018 and the case is at the stage of trial. 2.The petitioner has filed a petition for discharge under Section 245(2) Cr.P.C. Even before this petition was filed, the Court had already framed the charges and the case was at the stage of trial. Therefore, the Court below was perfectly right in returning the papers on the ground of maintainability.
