O R D E R
Earlier, this Court by an order dated 30.06.2021 in W.P.No.13170 of 2021 directed the 1st respondent therein to consider the petitioner's application and dispose the appeal filed by the petitioner on merit and in accordance with law after hearing the petitioner within a period of twelve weeks. Alleging that the order has not been complied within a stipulated period, the present Contempt Petition has been filed.
2. Today, when the matter taken up for hearing, Mr.S.Ravikumar, learned Special Government Pleader appearing for respondent submitted that, in pursuant to the order passed by this Court, the appeal filed by the petitioner was considered and order was passed on 04.04.2022 rejecting the appeal and also produced the copy of the order. Hence, this Contempt Petition may be closed. However, learned counsel appearing for petitioner would submit that, even though this Court specifically directed the respondent to dispose the appeal after the personal hearing of the petitioner, no personal hearing was given to him and without hearing the petitioner, the above order has been passed.
3. Considering the fact that the order has been passed in the appeal filed by the petitioner and if at all, the petitioner finds any irregularity in the order, it is always open to him to challenge the same in the manner known 2/3
to law. In the said circumstances, the order passed by this Court is duly complied with, and nothing survives to adjudicate further in this Contempt Petition. Accordingly, this Contempt Petition stands closed. However, liberty is granted to the petitioner to challenge the order if he so advised.
