JUDGMENT

Today, when the appeal came up for hearing, Mr.Bharath Kumar, learned counsel appearing on behalf of Mr.V.Nicholas, who is the learned counsel for the appellants, appeared before this Court through Video Conference and made a submission that the appellants are not interested in proceeding with the appeal.

2. In fact, this appeal is posted today, for taking steps to implead the legal representatives of the deceased appellant Nos.1 and 2. Further, on verification of records, it seems after the death of the respondent No.5, his legal heirs also not impleaded as a party. This would clearly shows that the parties are not interested in proceeding with the appeal.

3. Hence, in view of the same, the Second Appeal is dismissed for default. No costs. Consequently, connected miscellaneous petition is closed.
