Respondent PRAYER :Civil Revision Petition is filed under Art. 227 of Constitution of India, praying for a direction to the Hon'ble Subordinate Judge at Ponneri to dispose of the interim petition in I.A. 21 of 2018 in O.S. 145 of 2017 within the time frame as against the unfairness showed by the respondent in delaying the appeal endlessly.

This Civil Revision Petition has been filed seeking for speedy disposal of I.A. 21 of 2018 in O.S. 145 of 2017 on the file of Subordinate Judge, Ponneri.

2. Considering the nature of order going to be passed in this Civil Revision Petition, which would cause no prejudice to the respondent, notice to the respondent is dispensed with.

3. According to the petitioner, the respondent herein filed a suit for declaration to declare the rectification deed dated 19.08.2015 as null and void, and not binding on the plaintiff. In the above suit, the petitioner has filed an application under Order 7 Rule 11 of C.P.C. to reject the plaint. Even though the petitioner has advanced his arguments, so far, the application was not disposed of. Hence, the present Civil Revision Petition has been filed.

4. I have considered the submissions made by learned counsel appearing for petitioner and perused the materials available on record carefully.

Considering the limited prayer sought in this Civil Revision Petition, without going into the merits of the case, the learned Subordinate Judge, Ponneri is directed to dispose of the I.A. 21 of 2018 in O.S. 145 of 2017 after hearing both the parties within a period of four weeks from the date of receipt of the copy of this order. Accordingly, this Civil Revision Petition stands disposed of. No costs. Consequently, the connected Civil Miscellaneous Petition is closed.
