ORDER

The learned counsel appearing on behalf of the petitioner has filed a memo seeking to withdraw the present writ petition and the same is extracted hereunder:- "The writ petition has been filed against the award dated 31.10.2002 in I.D.No. 27 of 1991. The dispute was raised by the Unions seeking to espouse the cause of 138 workmen. The 138 workmen have since then retired from the services and settled their full and final dues with the petitioner Management without insisting on the relief granted in the impugned award or reserving their rights. The Respondent Unions are also not appearing before this Hon'ble Court in this writ petition to sustain the award. The petitioner therefore seeks to withdraw the writ petition with a liberty to restore if any of the workmen/Union were to make a claim in terms of the impugned award in future."

2. In view of the same, the petitioner is permitted to withdraw the writ petition with a liberty to restore if any of the workmen/Union were to make a claim in terms of the impugned award in future.

3. In view of the above, this writ petition is dismissed as withdrawn. No costs.
