Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the 1st respondent relating to Letter No. 47158/C4/SETC/06 dated 02/02/10 to quash the same and consequently direct the 1st Respondent to pay the pension to the Petitioner from the Corporation Pension Fund Scheme. This matter earlier came up for consideration before this Court on 04.07.2024 and it was brought to the notice of this Court that the petitioner is no more. Hence, the matter was adjourned for taking appropriate steps. Again, the matter was listed on 02.09.2024. However, there was no representation for the petitioner and no application is filed to bring on record the legal representatives of the deceased petitioner. Hence, the matter was directed to be listed under the caption "For Dismissal" on 03.09.2024.
2. Today, inspite of the matter being listed under the caption "For Dismissal", there is no representation for the petitioner nor any application is filed to substitute the petitioner. In the circumstances, this Court is left with no other option except to dismiss the Writ Petition as for nonprosecution as well as on the ground of abated. Accordingly, the Writ Petition is dismissed for non-prosecution. No costs. Connected Miscellaneous Petitions, if any shall stand closed.
