Read this in conjunction with and in continuation of separate order made in O.P.No.79 of 2020, wherein a sole arbitrator has been appointed.

2. As sole arbitrator has been appointed sub-section 3 of Section 9 of 'The Arbitration and Conciliation Act, 1996' (Act 26 of 1996), (hereinafter 'A and C Act' for the sake of brevity) operates. It is open to parties to place a photo copy of the instant application before learned Arbitrator along with supporting documents and typed set of papers with a request to treat the same as application under section 17 of A and C Act.

If such a course is adopted learned Arbitrator shall decide it on its own merits and in accordance with law uninfluenced by any observations made in O.P.No.79 of 2020.

3. Application is disposed of.
