Petition filed under Article 226 of the Constitution of India, praying for a issuance of Writ of Habeas Corpus by directing the 1st Respondent to retrieve Petitioner's daughter Priyanga, aged 21 years and produce her before this Court and set her at liberty.

O R D E R

(Order of the Court was made by R.HEMALATHA,J.,) The petitioner, namely, Venkataraju Vasudevan, has filed the present Petition for issuance of Writ Habeas Corpus directing the 1st Respondent to cause production of his daughter Priyanka, aged 21 years, before this Court.

2. In the affidavit filed along with the petition, the petitioner has contended that his daughter, namely, V.Priyanka was doing her 2nd year B.Sc-Maths in Sasthra College, Kumbakonam and that she went missing from 25.03.2018. Since he could not find out the whereabouts of his daughter, he lodged a complaint with Inspector of Police, Needamangalam Police Station on 29.03.2018 and an F.I.R. in Crime No.78/2018 of Needamangalam Police Station was registered. petitioner is that the 2nd Respondent had abducted his daughter, Priyanka.

2. A notice was issued to the 1st Respondent and in response to the notice, the detenue, namely, Priyanka was produced before this Court. We interacted with her and she contended that she fell in love with the 2nd Respondent and since, he belongs to Scheduled Caste Community, her father did not give consent for their marriage and instead took steps for her marriage with some other person. Resisting the marriage, she left the home on 20.03.2018 and married the 2nd Respondent on 21.03.2018 at Ranimahal, Thirupuvanam in the presence of her husband's relatives. She further contended that she is presently residing at No.1/62, Narikudi Colony Street, Valagaiamman Taluk, Thiruvarur District with her husband happily.

4. It is pertinent to note that the Detenue, namely, Priyanka is a major and this Court, is convinced that she would be in a position to take an independent decision on her own and does not require any guidance or instructions.
