O R D E R

Against the order passed in G.A.No.2 of 2002 dated 09.07.2003 confirming the order of the Authority under the Payment of Gratuity Act, dated 10.10.2001 in G.A.No.53 of 2001, the petitioner is before this Court.

2. As per the order impugned in this writ petition, it was declared that the first respondent employee is entitled to gratuity as per the schemes, rules and regulations under Payment of Gratuity Act, 1972.

3. However, when the matter is taken up for final hearing today, learned counsel appearing for the first respondent would report that the first respondent employee is no more and therefore, nothing survives for adjudication in the writ petition.

4. Recording the submissions made by the learned counsel for the first respondent, the writ petition is closed. No costs. Consequently, connected miscellaneous petition is closed.
