Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records in Na.Ka.No.6810/E2/2008 dated 16.06.2009 on the file of the second respondent and quash the same as illegal, arbitrary and direct the respondents to permit the 46 students who were admitted as additional intake during the academic year 2006-2007, to continue their course as 2nd year students for the academic year 2008-2009.

O R D E R

This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus calling for the records in Na.Ka.No.6810/E2/ 2008 dated 16.06.2009, on the file of the second respondent and to quash the same as illegal, arbitrary and to direct the respondents to permit the 46 students who were admitted as additional intake during the academic year 20062007, to continue their course as second year students for the academic year 2008 - 2009.

2.The petitioner was permitted to intake only 50 students, however, they admitted 46 students over and above the permitted intake, due to which, the Educational Authorities did not permit the 46 students to write the examination against which, the present writ petition has been filed.

3.The learned counsel for the petitioner reported 'no instructions'.

4.The learned counsels appearing for the respondents, on instructions from the Educational Authorities would submit that no interim order was granted in this writ petition and 24 students out of the 46 students were allowed to participate in the examination and would further submit that the petitioner has not admitted any students over and above the permitted intake from the year 2015 onwards.

5.In view of the above, nothing survives for further adjudication in this writ petition. Accordingly, the writ petition is closed. No costs. Consequently, the connected miscellaneous petition, if any, is closed.
