Respondent Prayer: Second Appeal is filed under Section 100 of the Code of Civil Procedure, against the judgment and decree dated 21.07.1997 and made in A.S.No.87 of 1995 on the file of the Principal District Judge, Pondicherry reversing the judgement and decree dated 25.07.2025 made in O.S.No.178 of 1990 on the file of the I Additional Sub Judge, Pondicherry.

ORDER
I disposed of the second appeal recording the compromise entered into between the parties on 27.10.2025. Both the counsels represent that in terms of the compromise, a sum of Rs.55,00,000/- has been paid by the appellants to the sole respondent. In addition, the respondent has also taken return of the amount deposited by him to the credit of O.S.No.178 of 1990 on the file of the learned I Additional Subordinate Judge at 2/5
Puducherry. This puts quietus to the litigation between the parties.
2. Ms.Veena Suresh reports that the original documents of the defendants/appellants are available in Court, as they had been filed by the respondent/plaintiff, before the learned Subordinate Judge. Since the defendants had paid the entire amounts due, in terms of the compromise, the plaintiff shall take back the records filed by him in O.S.No.178 of 1990. He shall return the original title deeds filed by him under due acknowledgment, from the defendants. On filing an application for return of documents, the defendants will have no objection to the plaintiff taking back the same. The said exercise will be carried out within a period of three weeks from today.
3. In case, the records has not already dispatched, the Registry is directed to send the records forthwith to the I Additional Subordinate 3/5
Judge at Puducherry.
