C.M.P.Nos.2439, 2445 & 2442 of 2019 in S.A.No.1624 of 2004 C.V.KARTHIKEYAN.J, These three applications have been filed consequent to the death of the 4th respondent, Jayapathi and the applications relate to condoning the delay in filing an application to set aside abatement, to set aside abatement and to bring on record legal representatives as respondents 13, 14 and 15. These applications have been pending for quite sometime. 2.Heard the learned counsel who originally appeared for the 4th respondent Mr.A.R.Nixon.
3.I would only be prudent that the applications are allowed and the matter is heard and notice is directed to the proposed respondents in the Second Appeal itself after making them as parties and then they can take a decision whether to contest the Second Appeal or not. 4.In view of the above reasonings, all these three applications are allowed.
